Overpopulation of the World and the Problems it Creates The world is faced with growing conservation problems daily, most of which are caused by an increasing population. In order to deal with the problems of overpopulation, the world needs to consider minimizing consumption, lowering waste byproducts, and keeping a hand on land management. Consumption is the act of using resources at an uncontrolled rate. It is mainly the result of overpopulation. The population of the world is growing by approximately 212,970 people per day and is said to reach nine billion people by 2040 (World Population). As the population increases at this rapid rate, the demand for food, water, and shelter will also rise just as quickly. Since the demand for goods like electricity and fuels also increase, we should consider using a more conservational method to create these items by using more abundant and replaceable resources. Water is the most abundant resources on the planet. Instead of using petroleum based fuels to run cars, we should use water. Scientists have already developed hydrogen powered vehicles such as cars, busses, scooters, and tractors (NREL). Another alternative for fueling cars are crops like corn that produce ethanol. Electricity is going to one of the most demanded items as the population grows. In some places, fuels are being used to create energy. Instead, abundant resources like sunlight, wind, and water should be used to generate all the electricity that is consumed. But, even with these methods of producing a â€Å"cleaner† energy supply, the general population will have to contribute to the conservation of the energy. Some simple things that people can do is :lower thermostats, use energy efficient bulbs, use drip irrigation to water flowers and fruits, use solar energy to dry clothes, and create a compost to dispose of that waste instead of throwing it away. As the population is growing, the amount of waste that is produced from the consumption will increase at a much more rapid pace. Each person per day produces about 4. 4 pounds of waste. The majority of this waste is thrown away in the trashcan, which is set at the curb to be picked up by a diesel truck polluting the air and using energy, only to end up in a andfill. With the increase in needs of food and other items, more and more trash will result. Recycling is the best way to fix this problem and keep 95% of trash out of landfills. It is projected that Americans will throw away over 11 million tons of glass bottles and jars 1 million tons of aluminum cans and foil more than1 million tons of aluminum cans and foil, over 4 and a half million tons of paper and nearly 10 million tons of newspaper (Center). Almost all of this material could be recycled, saving millions of trees and over 100% combined energy that is used to make new products. Businesses can also play their part in recycling things such as cooking oil that could be used as fuel in a vehicle. If we do not engage in actions to clean up the present landfills and prevent future ones, we could possibly be looking at problems such as contaminated water and soil. Land management goes along side of both consumption and waste. As the population increases, more space will be needed for houses, hospitals, schools and businesses. As a result, we must make room by methods such as destroying forest and filling in lakes, rivers, and streams. To us we may only see trees and dirty, microorganism infested water, but these two ecosystem house millions of species of animals and plants that are vital to our survival on Earth. Research states that the earth was once covered by 5. 8 million to 6. 2 million square miles of forest. Today only 2. million to 3 million square miles of forest still remains (Nielsen). By destroying these bionetworks, plants and animals become endangered and maybe even extinct. As a result, this causes entire ecosystems to collapse. Without plants, animals die and without plants and animals, the human species can no longer eat or breathe, therefore, becoming extinct itself. Humans can take control of this growing problem by considering options like apartment buildings or larger skyscrapers to t hings like online schools and e-shopping. Without a doubt, the population of the world is going to continue to grow, but that does not mean that the problems dealing with consumption, waste, and land management has to also. If we could use nature made goods like sunlight, water, and wind, we could reduce the amount of energy consumed, decrease the amount of waste produced, and decrease the amount of land destroyed that is needed to serve the population. The significant increase in the role of international trade in the economic development of nations over the last few decades has been accompanied by a considerable increase in the number of commercial disputes as well. Today rapid globalization of the economy and the resulting increase in competition has led to an increase in commercial disputes. At the same time, however, the rate of industrial growth, modernization, and improvement of socio-economic circumstances has, in many instances, outpaced the rate of growth of dispute resolution mechanisms Keeping in mind the broader goal of exploring links between the quality of legal performance, this assignment is an attempt to critically evaluate arbitration in India as a legal institution and to judge the growth and development of the same and to see the exact footing of India in the international front a simultaneous comparison of the arbitral laws of USA to that of India has also been made. In this assignment, the evolution of arbitration law and practice in India has been explored. This assignment is divided into three parts Part 1 explores the evolution of Arbitral laws in USA and India, the underlying idea behind this is to see the process through which arbitration came into being and how the old is the law and its due development in the respective countries. HISTORY OF ARBITRATION LAW IN UNITED STATES OF AMERICA Native Americans used arbitration as a means of resolving disputes within and between tribes long before Europeans journeyed to America’s Atlantic shores.However the use of arbitration was introduced in America by the revolutionary war by the colonists who had had business experience in Europe. The use of arbitration in the ports of Europe was already known at that time among maritime and trade businesses. The experience of arbitration as a means of dispute resolution which minimized conï ¬â€šict and allowed continuation of the business relationship was brought to Atlantic by the people coming to live and work in North America. In England, arbitration is a much older concept than the common law system, which the United States courts later adopted. In fact, in England arbitration was used as a common means of commercial dispute resolution from as long as 1224. George Washington, the first President of USA incorporated an arbitration clause in his will that basically stated that, ‘ if any dispute should arise over the wording of the document that a panel of three arbitrators would be implemented to render a final and binding decision to resolve the dispute.’ In the ï ¬ rst decade of the 20th Century, several major trade groups applied arbitration beneï ¬ ts of simplicity, speed and minimal enmity. When New York’s The Association of Food Distributors, Inc. (originally known as the Dried Fruit Association of New York) was formed, its bylaws included an arbitration panel for the resolution of disputes. This was done to reduce the risk that its disagreeing members in case of any dispute and after its settlement would find ,themselves unable to resume their business relationship.1 Until the early 1920s, the only law governing arbitration proceedings in the United States came from court decisions, some dating made in the cases in17th and 18th Centuries. In 1925, The Federal Arbitration Act was enacted. It was a recognition of the several beneï ¬ ts of arbitration and it thereby established a national policy which promoted arbitration.It was initially designed to overcome the judicial hostility that was existing towards arbitration which had evolved from the English courts. With the increasing industrialization and growth and development the reluctance of people to adopt arbitration decreased. With the rise in number of disputes mainly involving â€Å" a transaction of commerce† AMERICAN ARBITRATION ASSOCIATION was established by Moses Grossman in 1926 and an era of Alternate Dispute Resolution was started by Charles Bernheimer2 . The National Labour Realtion Act passed in 1930 marked the a steep rise in the concept and usage of Arbitration in USA. The second woeld war was the turning point for arbitration law in America the economic depression and arising conflict led to more and more dispute settlement by means of arbitration by the War Labour Board. A major milestone regarding Arbitration Law was Achieved in the 1970 when when the Uniform Convention on the  Recognition and Enforcement of Foreign Arbitral Awards (The New York Convention)3 became law in the United States by the addition of Chapter 2 to the Federal Arbitration Act.This convention is still effective and provides for International Arbitration Awards which is considered to be more reliable and consistent than the existing court judgement framework in the country. While I was growing up I believed that criminal justice meant an eye for an eye. As some people grow older his or her definition changed to, if an individual commits a crime, he or she should be held accountable for his or her actions. However; the punishment should fit the crime and be severe enough so the individual will learn from his or her mistake. A Pennsylvania (Penn) state assistant, Mike McQueary, claims to have witnessed Jerry Sandusky raping a ten-year-old boy in the shower (The New York Times, 2012). Sandusky (former Defensive Coordinator) was a wellrespected member of the Penn State community and good friend to Joe Paterno (former Head Coach). McQueary reported the crime immediately to Paterno. In response to the allegation, both McQueary, and Paterno reported the rape to Administrators Tim Curley (former Athletic Director) and Gary Schultz (former Vice President of Business and Finance) (The New York Times, 2012). The issue is at no time was the crime reported to police authorities. The allegation was simply brushed underneath the rug by several individuals. Continuing Professional Development In HRM In this essay the author presents a critical evaluation of the four stages of the Continuing Professional Development (CPD) cycle as a tool to support her CPD in Human Resource Management (HRM). The CPD process can be carried out by undertaking step-by-step process (see, Figure 1). However, the basis for most training remains the traditional training process system (see Figure2). Thus, we will use the traditional training process system for our analysis. Defining the CPD poses an interesting problem although a number of eminent researchers and organisation have categorised the different approaches. The Chartered Institute of Personnel and Development (CIPD) define CPD as the need for individuals to keep up to date with rapidly changing knowledge (Website 1). Other organisations refer to structured processes to maintain, develop and enhance skills, knowledge and competence both professionally and personally in order to improve performance at work (Website 2). The Chartered Institute of Management (Website 3) states that Effective CPD is a commitment to professionalism it shows that you have taken personal responsibility for ensuring that you have the skills and knowledge necessary to meet the challenges of an ever changing world. The process should benefit the individual, and also the business as a whole. Evaluation of the four stages of the CPD cycle The traditional training process system (see Figure2) of CPD cycle comprises four main steps: 1) Identifying development needs, i.e., identifying training and learning needs; 2) devising a learning plan prioritizing needs and selecting appropriate activities; 3) undertaking development activities and; 4) recording and evaluating outcomes (Megginson Whitaker, 2007). Now, if we consider the contents of the MSc in HRM, in relation to the CPD cycle and the authors approach to achieving her goals, i.e., completing the MSc in HRM with at-least merit pass for most modules together with appropriate particle experiences. The first step is that identifying development needs. According to Inglis (1994) identifying development needs means developing an Extraordinary Realistic Self Image (ERSI), which should consist the elements of work it self, reflection by self, feedback from others, individual psychometric self -diagnostic measures, organizational metrics and professional metrics. Moreover in the case of individual identifying development needs includes, feedback from others, self-assignment, reflection, personal professional congruence and aspirations / dreams. In this case, the author as an individual, taking all the above factors into consideration she set up her development needs as follows; by studying MSc in HRM she wish to develop her ability to make an effective contribution at a strategic level in todays rapidly changing organizational contexts, internally or externally. She also wants to learn more about the effective management and utilization of human resources in organizations. By the end of this course, she hope to achieve more knowledge about strategic perspective and operational perspective, also she would like to gain more knowledge and skills to motivate and manage employees, and become a reflective practitioner in this specialist field, so-called human resources management, and develop a strategic understanding of HRM in relation to organizational processes. At present the author is only an affiliate member of the CIPD and by the end of the course she aims to gain graduate membership of the CIPD and in the long time her as pirations is to become a fellow of CIPD. Now, she needs some criterion for deciding which of these needs should be given priority. In relation to this Stephen Covey (1990) emphasized the need to focus on the areas that are important and non-urgent. Megginson (1994) created a framework called SPICE, which covers a range of areas and has a memorable acronym. SPICE involves setting goals in the areas of spirit, physical, intellect, career and emotion. Another model presented by Hawkins (1999), so-called BEST model suggests that we can set goals that get the best out of us if we look for goals that help us to: Broaden move us into new areas; Enjoy get us doing more of the things that we love; Stretch take us into new areas, doing more, facing bigger challenges; Think -challenge our understanding and mastery, demanding deeper insight. The next framework to take into account is the modes model discussed in Boydell and Leary (1996). Each mode has certain key characteristics and strengths, and the large movements of our life, wh en we notice that we are viewing the world from a radically different perspective are about moving from one mode to the next. Figure 3 briefly describes each of the modes, which may help to identify where we stand in our development. The model begins at the bottom and as we develop we work up through the modes over the years. The author is adopting the BEST (Broaden, Enjoy, Stretch, Think) model for prioritizing her needs and selecting appropriate activities, it is in her view that this model is more appropriate to her case. Because, undertaking the MSc in HRM she gains more knowledge and skills in the field of HRM. She is enjoying doing the course and doing more of the things she love. On the other hand the course is quite a challenging one due to the nature of the course contents and the mode of study (i.e., full time) also the time constrain is a big factor. Thus, she is stretching her self to balance the professional and personal life. However, her desire to think ahead and fulfill her ambitions allows her to face the challenges and demanding her to do more to get a deeper insight of the subjects. Now, moving on to undertaking development activities, these should be in the form of professional work-based activities (e.g. work project and new task), courses conferences (e.g. CIPD branch meetings), and self-directed informal learning (e.g. reading, action learning and reflective diary). In relation to this the author is engaged in professional work-based activities via work-placement, which allows her to use the theories into practices that she learned though formal lectures and further readings. Moreover her self-directed informal learning such as readings, allows her to use wider theoretical concepts into her assignments, exams, and practical activities. This allows optimizing her knowledge and skills, as well as achieving her goals with confidences. Recording and evaluating outcomes the process of writing helps us to distil experiences, recognize patterns and discern trends. It enables us to remember what has gone before and capture lessons for the future. It can also be kept for CIPD upgrading applications (Megginson Whitaker, 2007). The author has included an evidence of her own reflecting back Continuing Professional Development (CPD) record and moving forward plan, which spans the period of her MSc in HRM taught programme and plan for further development. She was very pleased about her overall performance so far, but it is in her own view that she could have done even better in one or two subjects, however due to time constrains and other factors which are beyond her control made it difficult to perform on a highest level for those two subjects. Thus, for the future tasks, she will prepare well by reading wide range of materials including lectures notes and gathering vital information from varies sources, for example, this is particularly very important for her dissertation that will be the immediate future task for her. So far, the authors approach to formal educational CPD activities (MSc in HRM) explained generally with respect to CPD cycle. Now, she considers the whole CPD process by identifying further needs to journey through the CPD cycle again. With respect to MSc in HRM, assessing her current skills, she studied wide range of HRM functions, models and methods used in organisations. Through these studies she is now able to analyse and critically assess the function of the manager and organisation based management structures alongside the role of human resource management within a range of organisational settings. The authors able to demonstrate a critical understanding of a range of methods and models used in organisation and business analysis from the perspective of human resource management. She have an idea of how leadership developments and how learning development is functioning in an organization (e.g. coaching, and e-learning) and how is the annual pay review managed and application of Performance Related Payment (PRP) system worked; also an up-to date information about current legislations; the employee communications and how the people resourcing strategies managed. Thus, she has insight knowledge of wider area of Human Resource Management (HRM). Moreover the author is able to demonstrate a theoretical and critical understanding of the actors, context, mechanisms, processes, and procedures that regulate and shape the employment relationship, including an appreciation of the contrasting perspectives and interpretations within employment relations. Furthermore, she can demonstrate critical understanding and analytical awareness of how employment relations concepts, policies and practices are applied within organisations to contribute to the management of people and organisational performance. As she reflecting on the outcomes, it is her view that she need to apply the knowledge and skills gained over the year through her studies. However, it is important to note that the author developed her HR skills in the area of Employee Relations (ER) through the work placement; it has strengthened her ability through project management in real life situation. Natural selection, adaptation, and mutations are three components of the evolutionary process, each one having either positive or negative effects on the other. What exactly is natural selection? There are many variations of the definition but most agree that it must include the following concepts: some attribute or trait must vary among biological entities, and there must be a consistent relationship, within a defined context, between the trait and one or more components of reproductive success, where "reproductive success" includes both survival and the reproductive processes themselves (Futuyma, 1998). Throughout literature, there are numerous examples of characters who serve to reinforce moral values of both other characters, and the reader. These characters consistently choose to do the â€Å"right† thing in the face of severe adversity. For example, in the Parable of the Good Samaritan, the Samaritan man goes against all societal values to help the Jew after he had been left for dead by muggers. In To Kill a Mockingbird by Harper Lee, Atticus Finch serves as a shining beacon of morality in the face of the prejudice-ridden early 20th century Alabama. Atticus helps to develop healthy and moral attitudes in his children by encouraging them to avoid unnecessary conflict, to always strive to be the better person, but also to still be prepared to accept a challenge if it is necessary for doing what is morally right, which demonstrates his truly moral character. Being passive and avoiding conflict is often viewed as being weak, but in many cases, avoiding conflict can be the only responsible, morally correct choice. This is specifically demonstrated by Atticus Finch after Bob Ewell spits in his face. Atticus displays extreme restraint by refusing to fight Ewell. When asked to comment on the incident, he simply remarks, â€Å"I wish Bob Ewell wouldn’t chew tobacco† (Lee 291). In this case, Atticus demonstrates that he is perfectly willing to swallow his pride and do what is right. Secondly, Atticus further expands on this attitude by teaching his children that it is wrong to fight with neighbours, no matter what insults are said to them. After Mrs. Dubose tries to antagonize Jem, Atticus advises: â€Å"†¦hold your head up high and be a gentleman. It’s your job to not let her make you mad† (Lee 133). On this occasion, Atticus is teaching his children the old proverb of â€Å"sticks and stones† – that people should learn to ignore things that others say about them. By being peaceful and restrained towards Bob Ewell, and requiring his children to do the same to Mrs. Dubose, Atticus is teaching his children how to avoid conflict and handle situations properly, which is a critical element of acting morally. It is often difficult to travel on moral high ground, especially when there is pressure not to, but experience teaches us that it is always the best option. In To Kill a Mockingbird, Atticus provides a clear example of how to be the better person when forced into an uncomfortable situation. After Jem  destroys Mrs. Dubose’s garden, Atticus has to teach his children that people are not always going to be kind to them, especially with Atticus’ role in the Tom Robinson case, but they must still treat everybody with respect. Atticus tells Scout, â€Å"It’s not fair for you and Jem, I know that, but sometimes we have to make the best of things† (Lee 139). In this example, Atticus is teaching his children that no matter what happens, always try to be positive about it, and never to let their detractors bother them. Additionally, Atticus does not condone his children fighting. Once again, Atticus knows that there are always going to be people that are unkind to them, but that fighting will not make the situation any better. Scout mentions, â€Å"Atticus had promised me he would wear me out if he ever heard of me fighting anymore; I was far too old and big for such childish things, and the sooner I learned to hold in, the better off everybody would be† (Lee 99). In this instance, Scout remembers that Atticus does not permit her to fight with others because it is immature and damaging, regardless of what caused the fight. Therefore, Atticus’ attitude towards conflict, to be the better person, demonstrates that he understands how to behave morally when presented with conflict. Doing the right thing is often significantly tougher than indecision, or even doing the wrong thing. In To Kill a Mockingbird, Atticus Finch proves that doing the right thing might be difficult, but it is always the preferable choice, and that it is never impossible. In 1930s southern Alabama, racist or otherwise prejudiced attitudes are plentiful. This can make morally correct choices difficult. When Atticus Finch took the Tom Robinson case, he knew that the popular opinion of the residents of Maycomb would be against him. However, he understands that taking the case was the right thing to do, and that he must do it. When Atticus is explaining his decision to take the Tom Robinson case, he states, â€Å"This case, Tom Robinson’s case, is something that goes to the essence of a man’s conscience – Scout, I couldn’t go to church and worship God if I didn’t try to help that man† (Lee 139). By saying this, Atticus is acknowledging that although Maycomb may be against him, he knows he has to help Tom Robinson because it is the only way to do what is morally right. Later, Tom Robinson’s life is threatened by a mob who want to break into the jail and murder him. Atticus  is warned of this, and he goes to the jail in order to help Tom. Atticus prevents the mob from reaching Tom, telling them, â€Å"You can turn around and go home† (Lee 202). At this time, Atticus understands that he could be attacked and potentially injured, but he knows that he must make the morally correct, albeit challenging choice, and go to the jail to protect Tom. Based on this evidence, it is clear that Atticus understands that some of the choices that he has to make will be difficult, such as defending Tom Robinson in court, or protecting him from the mob. However, Atticus knows that they are the only morally right choices, and therefore the only choices he may permit himself to make, as he is a strong moral character. Acting morally does not require perfection, and any person or character will have minor flaws and imperfections. In Harper Lee’s To Kill a Mockingbird, Atticus Finch serves as a near-perfect role mode in contrast to the chaotic environment of 1930’s Alabama. His desire to avoid inane conflict, always strive to be the better person, and accept challenges in the process of doing what is right demonstrate his true sense of righteousness, and call us to act as better people in the face of adversity. If adopted by everyone, Atticus’ actions, attitudes and principles would make the world a much more pleasant place to live in.
